These Terms of Service (“Terms”) govern your access to and use of The Sound System and The Sound System for Creatives mobile applications (collectively, the “Apps”), operated by The Sound System LLC (“Company,” “we,” “our,” or “us”).

By creating an account, accessing, or using the Apps, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Apps. By using the Apps, you represent and warrant that you meet this requirement.

2. Account Registration

Users must create an account to access certain features.

You agree to:

• Provide accurate and complete information

• Maintain the security of your login credentials

• Notify us immediately of any unauthorized access

You are responsible for all activity under your account.

3. Licensed Music Streaming

Music streaming available within the Apps through Feed.fm is licensed and provided via Feed.fm’s official SDK.

The Company does not host or distribute unlicensed commercial music libraries.

4. Creative Submissions (Artist/DJ App)

Users of The Sound System for Creatives may submit music links and related content for review and potential publication within the Apps.

By submitting any content, you represent and warrant that:

• You own or control all necessary rights to the content

• The content does not infringe any copyright, trademark, or other intellectual property rights

• The content complies with all applicable laws

• You have full authority to grant the Company the right to display and distribute the submitted content within the Apps

All submissions are subject to manual administrative review and approval before being published.

The Company reserves the right to reject, remove, or disable access to any content at its sole discretion.

5. Prohibited Conduct

You agree not to:

• Upload or link to music or content you do not have the legal right to distribute

• Upload pirated, unauthorized, or infringing material

• Circumvent security or licensing mechanisms

• Reverse engineer, modify, or exploit the Apps

• Use the Apps for unlawful purposes

• Attempt to interfere with other users’ experience

Violation of these rules may result in account suspension or termination.

6. Intellectual Property

All app design, branding, logos, software, and platform functionality are the exclusive property of The Sound System LLC.

Users retain ownership of their submitted content but grant the Company a non-exclusive, worldwide, royalty-free license to host, display, and distribute such content within the Apps.

7. In-App Purchases

Certain features may require payment via Apple In-App Purchases.

All payments are processed through Apple. Refunds are subject to Apple’s policies.

The Company does not process or store payment card information.

8. Content Moderation and Removal

We reserve the right to monitor, review, and remove content that violates these Terms or applicable law.

We may suspend or terminate accounts that repeatedly violate intellectual property rules or misuse the platform.

9. Disclaimer of Warranties

The Apps are provided on an “as is” and “as available” basis.

We make no warranties regarding uninterrupted service, error-free functionality, or continuous availability.

10. Limitation of Liability

To the fullest extent permitted by law, The Sound System LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Apps.

The Company is not responsible for content submitted by users, including Creative users, and disclaims liability for any infringement arising from user-submitted content.

11. Indemnification

You agree to indemnify and hold harmless The Sound System LLC from any claims, damages, liabilities, and expenses arising from:

• Your violation of these Terms

• Your submission of infringing or unlawful content

• Your misuse of the Apps

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or misuse of the Apps.

Upon termination, your right to use the Apps will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Apps after updates constitutes acceptance of the revised Terms
